The TCEQ regulates small construction under permit #TXR150000. Specific requirements can be found by downloading a .pdf version of the permit.
This permit requires any construction activities disturbing more than 1 acre of land to prepare and implement a Stormwater Pollution Prevention Plan (SWPPP). The State requires a SWPPP for permit compliance. The City of Mansfield requires all construction sites to be in compliance with the State permit, and has enforcement options for a missing, inadequate or incomplete SWPPP.
An SWPPP alone is not the final solution to preventing polluted runoff. BMPs in place must be inspected and maintained for effectiveness. Ineffective BMPs need to be replaced or altered in order to prevent pollution from entering our local waterways. The SWPPP will contain a list and site map for all BMPs throughout the construction process. However, implementation of the BMPs should follow construction phasing.
An SWPPP does not have to be a large unwieldy document to be complete. Many firms are now including text on a construction design plan page as an SWPPP. There is no requirement that an SWPPP be bound, or even more than one page. It must address the sections below completely and be updated and maintained properly.
The TCEQ identifies requirements for 9 sections of a SWPPP in the permit. For specific information on SWPPP content requirements, refer to TXR150000 Part III Section F (pages 21-28) of the permit. The following is a brief summary of the 9 sections.
- Site Description
- There are an additional 9 requirements to fulfill this section.
- Best Management Practices List
- A list of BMPs to be used on the site and the general sequence for when they will be used.
- Structural Control Practices
- Sediment basins are required on site disturbing greater than 10 acres. Sediment basins ARE different from detention ponds.
- Permanent Stormwater Controls
- Describes control measures placed during construction that will control post construction stormwater runoff.
- Other Controls
- A list of control measures addressing additional construction site runoff issues.
- Approved State and Local Plans
- SWPPPs are required to be in compliance with State, Federal and Local erosion and sediment control regulations.
- Maintenance
- When BMPs are not operating properly maintenance must be performed before the next rainfall event, or as soon as practicable. Erosion and sediment controls that have been intentionally disabled, run-over, removed, or otherwise damaged must be repaired or replaced IMMEDIATELY upon discovery.
- Inspections of Controls
- The inspection program selected for the site MUST be specified in the SWPPP. See this section of the permit for available options. Failure to properly inspect BMPs can lead to State and City fines. Fines are levied per BMP per day and can grow quickly.
- Non-Stormwater Pollutants
- The SWPPP must identify all sources of pollutants and control measures used to prevent the pollutants from running off the site.
